The Mullaperiyar dam on Periyar river has once again resurfaced as a source of dispute between the governments of Kerala and Tamil Nadu. The trigger this time: the floods in Kerala that left at least dead and 54 lakh — a sixth of its population — directly affected. Although the dam is located in Kerala, it is operated by Tamil Nadu following an lease indenture for years that was signed between the Maharaja of Travancore and the Secretary of State for India for the Periyar Irrigation works. Constructed between and , the dam redirected the river to flow towards the Bay of Bengal, instead of the Arabian Sea and provide water to the arid rain region of Madurai in Madras Presidency. The lease is also the source of the many litigation surrounding the dam.

These rumours are creating unnecessary panic among people living in downstream in the Periyar catchment," Water Resources secretary Tinku Biswal said. According to the CWC report, the average release from the Idukki reservoir on August 15 was about 1, cumec, with peak release of 1, cumec against the average inflow of 1, cumec. The Kerala government had yesterday filed an affidavit in the Supreme court, saying the sudden release of water from the Mullaperiyar dam by the Tamil Nadu government was one of the reasons for the unprecedented flooding in the state. The bench observed that it was not an expert to deal with such severe natural calamity and was leaving to the executive to contain the crisis. The Supreme Court today ordered that the water level at the Mullaperiyar dam be maintained at feet till August 31 keeping in mind the gr Kerala government has described the crisis as "extremely grave" and rescue operations are underway.

In view of the downstream devastation that a failure of the year-old Mullaperiyar Dam can cause, in January , lone crusader Advocate Russel Joy got the Supreme Court to issue a directive to the governments of Kerala and Tamil Nadu, and the Union Government, to constitute immediately an action-ready disaster management team. The unpreparedness of the team became apparent when disaster struck in the unprecedented torrential monsoon of Release of water to lower the level by just two feet, without proper warning or steps to protect people downstream, led to a horrific loss of life and property. But independent scientific inquiries beg to differ. The first page of the grossly partisan treaty of gives away the real reason for the British wanting the virgin territory, says Joy. It gives the British rights to 8, acres of equatorial virgin rainforest abounding in rosewood and teak which were shipped to grace the grand buildings of England.
