ICJ PREAH VIHEAR PDF

The United Nations International Court of Justice ICJ today ruled that Cambodia has sovereignty over the whole territory of the Preah Vihear temple, and that Thailand is obligated to withdraw its military personnel from the area. The temple and its vicinity have long been a bone of contention between the neighbours and have in recent years led to deadly clashes between them. In a June judgment, the ICJ found that the temple is situated in territory under the sovereignty of Cambodia, and that Thailand is under an obligation to withdraw any military or police forces, or other guards or keepers, stationed at the Temple or in its vicinity on Cambodian territory. In its decision today , the Court declared unanimously that the Judgement decided that Cambodia had sovereignty over the whole territory of the promontory of Preah Vihear, and that Thailand is obligated to withdraw its forces from that territory. In this respect, the Court recalled that Cambodia and Thailand — which are both parties to the World Heritage Convention — must cooperate in the protection of the site as a world heritage.

Established in under the UN Charter , the ICJ — sometimes referred to as the World Court — settles legal disputes between States and gives advisory opinions on legal questions that have been referred to it by authorized UN organs or specialized agencies. The United Nations highest court today began new hearings on a spectacularly situated year-old Hindu temple that has long been a bone of contention between Cambodia and Thailand and has in recent years led to deadly clashes between the two South-East Asian neighbours.

UN court rules for Cambodia in Preah Vihear temple dispute with Thailand

On 28 April , the Kingdom of Cambodia submitted to the Court, by an Application filed in the Registry, a Request for interpretation of the Judgment rendered by the Court on 15 June in the case concerning the Temple of Preah Vihear Cambodia v. Following that inclusion, several armed incidents took place between the Parties in the frontier area close to the Temple. On the same day that it filed its Application, Cambodia, stressing the urgency and the risk of irreparable damage, also filed a Request for the indication of provisional measures. On 21 November , within the time-limit fixed for this purpose, Thailand filed written observations on the Request for interpretation submitted by Cambodia.

Preah Vihear Temple

Cambodia complained that Thailand had occupied a piece of its territory surrounding the ruins of the Temple of Preah Vihear, a place of pilgrimage and worship for Cambodians, and asked the Court to declare that territorial sovereignty over the Temple belonged to it and that Thailand was under an obligation to withdraw the armed detachment stationed there since In its Judgment on the merits, rendered on 15 June , the Court noted that a Franco-Siamese Treaty of provided that, in the area under consideration, the frontier was to follow the watershed line, and that a map based on the work of a Mixed Delimitation Commission showed the Temple on the Cambodian side of the boundary. Thailand asserted various arguments aimed at showing that the map had no binding character. One of its contentions was that the map had never been accepted by Thailand or, alternatively, that if Thailand had accepted it, it had done so only because of a mistaken belief that the frontier indicated corresponded to the watershed line. The Court found that Thailand had indeed accepted the map and concluded that the Temple was situated on Cambodian territory.

Affording a view for many kilometers across a plain, Prasat Preah Vihear has the most spectacular setting of all the temples built during the six-century-long Khmer Empire. As a key edifice of the empire's spiritual life, it was supported and modified by successive kings and so bears elements of several architectural styles. Preah Vihear is unusual among Khmer temples in being constructed along a long north—south axis, rather than having the conventional rectangular plan with orientation toward the east. The temple gives its name to Cambodia's Preah Vihear province, in which it is now located, as well as the Khao Phra Wihan National Park which borders it in Thailand's Sisaket province, though it is no longer accessible from Thailand. In the ICJ ruled that only the temple building belonged to Cambodia, while the direct way to access the temple was from Thailand [4] , but currently, as of at least , the only access is from inside Cambodia. Although this structure is very different from the temple mountains found at Angkor , it serves the same purpose as a stylised representation of Mount Meru , the home of the gods. The approach to the sanctuary is punctuated by five gopuras these are conventionally numbered from the sanctuary outwards, so gopura five is the first to be reached by visitors.
